CIVIL ACTION LIABILITY QF SHIPOWNERS Mr. W. G. Riddoll, S.M., yesterday morning delivered-reserved judgment in the case of Griffiths and Co., Ltd., and Hutchings and Abbott (Mr. T. Young) against tlio Union S.S. Company 'Mr. P. Levi). Plaintiffs claimed £27 from the ,defendant company for loss caused through damage to 54 cases of bananas carried from Suva to Wellington. Tlio fruit was shipped by the s.s. Taluno and transhipped at Auckland. After rcviov.'ing tlio evidence, tho Magistrate stated that "tlio question of liability depended upon whether defendant's servants took all reasonablo precautions _to prevent damage. Ho was of opinion that there wag proof of failure on the part of defendant's servants'to stow the bananas in such a way as to obtain the host ventilation under tlie existing conditions. Judgment was given for plaintiffs for amonnt claimed,'. £27, and costs £11 IBs.' ■ : > BREACH OF AWARD.' The Inspector of Awards (Mr. G. H. Lightfoot) proceeded against 'R. Hannah and Co., Ltd., to recover a penalty of £10 for a breaoli of tlio Boot Operatives' Award, in that, defendants had failed to pay wages duo to their operatives, both male and Female, within five minutes of this close of the working day on July 21, that being tho day on which wages were paid. Mr. G. G. G. Watson, for Hannah and Co., explained that the firm employed 100 females and 12G males, and It was a physical impossibility to comply with the terms of tbo award as in paying the hands. Thb Magistrate agreed that it was npxt to impossible to do so, and gave judgment for plain, tiff for Is. UNDEFENDED CASES. Douglas (sued in respect of her separate estate). JUDGMENT SUMMONS. , In a judgment summons ease, Theobollard was ordered to pay D. Rohan and Co. tho. sum of £14 19s. 3d. by instalments per month. POLICE CASES. For insobriety, Agnes Milligan was lined os., in default 48 hours' imprisonment, and Lilian Jukos was fined 10s., in default three days' imprisonment. May Houston was convicted 'aild ordered- to come up for sentence when called upon, and at her own .was ordered to enter the Magdalene Homo, Christchurch. Gordon Graham was charged with on April 24 obtaining £15 from Geofga Swann, of Wanganui, by means of a valueless chequc. He was remanded to appear in Wanganui on Monday.
