A debtor who appeared at the Magistrate's Court at Auckland last week in answer to a judgment summons said that ho had a wife and five children, and ra earning J!2 10s. per week. Out of this ho had to pay 15s. rent, and lie was already in debt to the extent of about X2O. Ho was unable to make any offer to tho judgment creditor. The Magistrate inquired from the solicitor who appeared in tho ease what grounds tho plaintiff had had for believing that tho mail, since tho date of the judgment, had sufficient money to pay the iloVt. The solicitor remarked that tho usual affidavit had been filled in, and that the deltor was entitled to costs if lie asked for them. TIIO Magistrate, in dismissing tho case, awarded the debtor ss. costs, ao.I said that ho wished solicitors -would Tead Law Reports 2, eh. 753, and 1 ex. 100. Always order "NAZOL" by name.
