A TEACHER'S APPEAL CASE

In connection with the appeal b y jj r Bowater schoolmaster, against his. transference, Mr. 1 Justice Edwards this morning ga\e oil certain points of law laised by the Education Board The point was, under Section 53 of the Act, the question being asked whether, if the Appeal Board decided that Bowater was wrongly transferred, the. Education Board was bound to reinstate him or had the option of giving him another position equal in salary .Mr. Justice Edwards decided that if Bowater establishes his case he would be entitled to reinstatement ill his old position. His Honour iul6(l;thftt Section 18 of the Education Act was ultra vires and not binding;, that Tegelation 20, paragraph L, was not ultra vires. The Education Board was ordered to pay costs of the proceedings, amounting to fifteen guineas, and disbursements. The Appeal Board is now hearing the cases.
