MAGISTRATE'S COURT
Mr. D. G. A. Cooper, S.M., had a prolonged'- sitting yesterday, when the following cases were disposed of . BY-LAW CASES. _ For Sunday selling, James Wright, Maurice Le Harry, Len Cain, Albert Newson, and Gertie Pearce were each lined os., and costs, in default 21 hours' imprisonment. Mrs. Edie, charged with having on March 31 travelled between Lower Hutt and Trentham without a railway ticket, was fined £2, and costs, in default a fortnight's imprisonment Andrew Rogers, for getting into a train while in motion, was fined 55., and costs, in default 24 hours' imprisonment. George Anson, for failing to give" notice of tho . change of ownership of a motor-car, was filled 10s., and costs, in default 4S' hours' imprisonment. He was further convicted on two charges of not having a • proper registration marlc, and travelling without a tail-light,, and fined ss.'on each. Harold. Hudson, charged with driving a motor-car at a' greater speed than six miles an hour round a corner wus fined J!i, in default three days' imprisonment, lor driving without a certificate of competency he was further fined ss.,Vor 24 hours. John Patrick Casey, who neglected to stop his motor cycle when called upon by a police constable, was fined 10s., and costs. ~ • " A charge against Daniel Chapman of having .on, May .5; driven ,'a .motor-car. in Willis Street in a manner dangerous to the public, was adjourned; until June 2. For riding bicycles in Hiddiford Street without lights, Herbert, Hadifin was fined os., and costs, and Eric Johnson, George Sandbrook, and William Puddle 10s. John' Alfred Shirley was fined 55., and costs, for driving a'motor-car in Taranaki Street without a tail-light. For leaving'a trap .without locking a wheel, William John Haines was fined 55., and costs; and Harry Mitchell, on a charge of leaving an express unattended, was fiued 10s. ' ..'Joseph-H. Gavin,.who.allowed hischimlioy.to catch fire, was fined 55., and costs. •Henry Grant, for driving- a vehicle without lights, was fined 55., arid. Alfred W. Green, for- not keeping near enough to the footway in' Dutferin ' Street, was fined 10s. .'MISCELLANEOUS. ', Victor Tipine was convicted of tho theft of 4s. 6d., the property of John Hustler, and ordered to come up for sentence when called upon. Edna Miller, aged 18, who was charged with stealing several articles of clothing, was convicted and discharged, on condition that she entered the Salvation Army Home for six months. . For drunkenness, John Ingram Collie was fined 40s.,'in'"default seven days' imprisonment. Rate Dooley was fined 10s., $a default 48 hours' imprisonment. w Benjamin Hopkins, for disorderly behaviour while drunk in Lambton Quay, was. fined 405., in default .fourteen days' imprisonment. Julia Solina Shultz; a prohibited person, forobtaimng ]iqttor\was fined £2, in default seven days' imprisonment. 1 ' Bartholomew Mahoney, another prohibited person, on two charges of entering hotels was filled £1, in-;default,three days', imprisonment. - - - For obscene language, Alex. Wilson was .fined £2, .with tho' alternative of fourteen £ays' imprisonment; and Richard Clapbam .£3, in default 'a month's imprisonment. Alexander Russell, the father of three children in the -Wellington Receiving Home, was ordered to pay 7s. 6d. a week towards the maintenance of each, while Arthur Williaim Russell, the grandfather, was ordered to contribute 2s. (jd. , James Ashby, charged with lieing a prohibited person, he entered an hotel, was convicted and ordered to como up for sentence when called upon. Charged with failing to attend drill,' Cyril Cummings, Norman Olson; and Cecil L. J. Oxeuham were fined 55., and costs; James M'Glinchey, T.eo Shaddock', and Thomas Bell, 10s.; and William Thomas Newman, j!l, in default seven days' imprisonment. A juvenile of. 15 years of ago, charged with'stealing six five-pound tins of tea of the value of £2 10s., the property of W. and G. Turnbull and Co;, was "sentenced to twelve strokes of a birch rod, his parents being ordered to pay ,£1 4s. Francis Samuel Qiarlton (18), who had '.received sorne of the tea knowing it to bo stolen, was fined Ms., and ordered to refund j;i 4s. . 'RESERVED JUDGMENT. Yesterday Mr. W. G. Riddel!, S.M., delivered judgment in the case of Hamilton Gilmer v; P. Rogers, licensee of the Te Aro Hotel, a claim for .£197 Us. 8d.,! damages for alleged breach of contract and unpaid insurance premium. By mutual agreement the claim had been reduced to : <£93 3s. for breach of covenant to renovate the premises under lease during 1914. His Worship held that as Rogers was not the original lessee ho could not bo held responsible for the non"ullument of obligations which ought to liavo been performed before Rogers became the lessee by assignment. • Judgment was therefore entered for defendant, with ,£1 13s. solicitor's fee! Mr. T. Young appeared for defendant, and Mr. A. W. Blair for plaintiff.
