SOUTHERN COURT-MARTIAL
ACCUSED FOUND NOT GUILTY, By Telegraph—Press Association. . Christchurch, May 25. The court-martial on i'ergt. Julian. Prosper, who was charged that lie struct his superior officer whilst on duty, was resumed, and further evidence was called for the defence. After a somewhat lengthy retirement the President read the Court's finding: "Accused did strike .his superior officer; accused was by improper treatment accorded to him by Lieut. Lennon, worked up to a state of extreme irritation that would affect his clearness of mind at the moment of the assault. Accused wna justified by what transpired in thinking that Lieut. Lennon intended to carry out his tiireat of throwing him into the river, and the hand of the lieutenant struck the accused on the face, and whether intentionally or not, at the moment oMhe assault, and the accused had in his then state of mind reason to believe the danger of personal injury. The Wow struck was an instinctive act of one skilled in boxing, and not premeditated. The decision of the Court is that accused was not guilty.
