COURT OF APPEAL

A BILL OF SALE

His Honour the Chief Justice (Sir Robert Stout) presided on tho Court of Appeal Boncli yesterday, and sitting with him were Their Honours Mr. Justice Edwards, Mr. Justice Cooper, and Mr. Justice Sim. The business before tho Court was the plaintiff's appeal against the decision of His Honour Mr. Justice Chapman in the case of the Official Assignee at Dannevirke in the estate of Douglas Roy Bailey, of Matamau, farmer, against the union Bank of Australia and the executors of tho estate of the late Wm. Bailey. The question at issue in tho court below was whether the proceeds of the sale of certain cattle and horses seized under a bill of sale by the bank belonged to the bank os mortgagee or to tho Official Assignee in the estate. His Honour was of opinion that tho security held by the Union Bank was valid, but did not apply to the horses. Judgment was given accordingly with costs. Against this decision the Offical Assignee appealed on the ground that it ivas erroneous in law.

Mr. T. H. G. Lloyd, of Dannevirke, appeared for the appellant, while Mr. M. Myers appeared for the Union Bank. The Court reserved decision.
