MAGISTRATE'S COURT
MAINTENANCE CASES
Mr. D. G. A. Cooper, S.M., presided at yesterday's sitting of the Magistrate's Court, and had a fairly long list nf cases before him. -Numerous maintenance matters wero set down for hearing, but the majority of them were set back to later dates. Daphne England proceeded against Phillip Desire England for separation and maintenance and custody of the one child of the marriage. Separation was agreed to, but the question of custody was in dispute, and lengthy evidence was called on tho question. - The Magistrate eventually granted custody to the wife, and ordered the defendant to contribute tho sum of £2 weekly as maintenance: Mr. P. W. Jackson appeared for complainant, and Mr. E. C. Lovvey for tho defendant. Hubert Broderick admitted the paternity of an illegitimate child, and was ordered to contribute maintenance at the rate of 7s. 6d. per week. Samuel Blood, who was in arrears with payments due under a maintenance nrrler, was sentenced to five days' imprisonment, but may evade arrest by keeping up weekly payments of £1 12s. 6d. ' ■ SALUTARY SENTENCE. "This is certainly a case for a heavy penalty," said the Magistrate in passing sentence upon .Arthur .Roddy for obscene exposure at the Basin Reserve. Tho accused, a middle-aged man, pleaded not guilty to tho charge, but, after hearing'the evidence of Sergeant' Scott, of Mount Cook, and two little girls, the Magistrate decided that a conviction' should bo recorded.- A sentence of one year's- imprisonment was passed. LYALL BAY AFFAIR. John Denahy, against whom there I nere previous convictions.for drunkenness and vagrancy, i)leadscl guilty to a charge of wilful damage at Lyall Bay on March 19. Chief-Detectivo Boddam said that complaints had been made that holes had been bored in the floor of tho ladies' dressing shed at Lyall Bay, and the accused, when arrested by Detective-Sergeant Lewis, admitted having caused the damage. The Chief-Dctectivo-.added that Denahy was a sexual pervert, and for certain reasons a term of imprisonment would be of benefit to him.. The Magistrate sent I Denahy to gaol for one month. SOLDIER IN TROUBLE. A soldier, named Joseph Sutherland, pleaded guilty to a charge of having refused to quit tho Alhambra Hotol when requested to do so. He, however, denied that ho had resisted Sergeant Willcocks. while the latter in the execution of his duty was removing Sutherland from the hotel. After hearing tho evidence, the Magistrate decided that Sutherland must bo'convicted on tho fiocon'd chargo, as well as on the first. A fine of 20s. in each case was imposed, the Magistrate fixing the default at three days' imprisonment, and directing that the accused should he handed over to the - military authorities when tho sentence of the Court was complied with. REMANDS GRANTED. ' John Dillon, whose ago was_ given as 25 years, was remanded until to-mor-row'on a charge of. assault and robbery. It is alleged that on Saturday Dillon assaulted George Lewis Raddon, aged G2 years, and robbed him of a Post Office Savings Bank book. Inspector Hcndrey stated that the police were quite ready to proceed with .tho case, but, as it was an indictable charge, Wednesday was the proper day for hearing. William Milne pleaded guilty to a chargo of having absented himself from the steamer Opawa without first having obtained leave. He was remanded until this morning for sentence. INSOBRIETY. Convictions for drunkenness were recorded against the following: Michael O'Brien, prohibited and lined £2, with the alternative of seven days' imprison; ment; William Connelly, fined 205.. orthroe days' imprisonment; Edith Potter, fined 205., or three days' imprisonment; and four first offenders, who were leniently treated.
