INNOCENT MAN'S FINGERPRINTS

POLICE NO RIGHT TO KEEP THEM.

The Court of Session, Edinburgh, recently gave judgment in an'appeal by James Adamson, 31 High Street. Perth, against Matthew J. Martin, Chief Constable of Perthshire, for the delivery of Adamson's photographs and fingerprints and for £200 damages. Adamson was .charged at Perth last year ivith theft. He was liberated without having to find bail, and his photograph and finger-prints were taken at trie County Police Office. The finger-prints were taken on a paper on which was printed: "To tho Registrar of Habitual Criminals, London." Afterwards Adamson was tried and acquitted. He contended that the police had no right to take the photographs and the finger-prints, and claimed that these should be delivered to him to be destroyed. His claim for damages was on the ground of slander. The Court granted an order that the photographs and finger-prints should be destroyed, but did not allow damages. By a majority of tlie Court Adamson was found entitled to three-quarters of the costs.
