« SUPREME COURT In the Supreme Court yesterday morniiifj, His Honour Mr. Justice Hoslung concluded the hearing of the civil action ui which Francis H. M. \\ilford for tlie defendant. , , The plaintiff alleged thai' the defendant had erected a structure over a stream at Johirsonville, thereby creating a nmaance, "bv reason of which the plaintiffs property had been flooded and seriously damaged. The claim was for =£100 damages, and an injunction restraining the defendant from continuing the nuisance. Defendant denied that, the erection o the structure hud crcated a nuisance, and said that tho plaintiff had expressly acquiesced in the work at the tiino it was carried out. . His Honour reserved decision, but suggested that counsel 'might confer with 11 view to seeing if a settlement could not be arrived at before the decision is written. .NOTICE OF APPEAL. Notice of appeal lias been lodged by Mr, E. G. Jcllicoe in the, case of the young man, Francis Peter Sagen, who was last week fined JS2S by Mr. D. G. A. Cooper, S.M., on a charge of making disloyal utterances. The appeal will come on for hearing in the Supreme Court after th< long vacation./
