Aitkon and George Wilson, defendants, on a claim of £0000 damages for al-' loged misrepresentation; was continued in the Supreme Court to-day. Continuing under cross-examination, John Keir said he heard rumours in regard to Fry's, agency which made him suspicious. . G. Fitzgerald gave expert evidence in connection with the buildings and lease. ' 1 Ferguson Mnnro said he had had previous experience in wholesale business. He was assured .that the Aitken and "Wilson business was transferred with all agcncies. Under cross-examination, witness' said' that Mr. Aitfcen told him it would require £10,000 capital to run the business. _ 1 Mr. Smith, solicitor, said before he paid over tho £6000 from his clients,, he asked Mr. Wilson about agencies. Mr. Wilson replied: "We aro not'guaranteeing any agencies." Witness said lie understood that, but when his clients took the business the agencics go with them. At this stage Mr. Skerrett moved for a nonsuit. I-lis Honour reserved his decision on the points raised, and the case was adjourned.
