I>y December 23, in : default to undergo ds honrs' imprison- . ment. A RESERVED JUDGMENT. 1 Reserved judgment was delivered in the case of John Contessa v. Laurence M'Donald. The claim was for JESO damages in respect of a collision on tlio Paeltakariki Hill between plaintiff's motor-cycle and defendant's motor-car. The plaintiff was awarded .£39 75., and costs totalling JIB Bs. Mr. J. F. W. Dickson appeared for the plaintiff and Mr. G. G. Watson for the defendant. BREACH OP AWARD. In, the case of the Inspector of Awards (W. Slaughter) v. li. I£. Knight, a claim for .810 as penalty for breach of the Carpenters' Award, the defendant did not appear. After hearing the evidence, called by the inspeotor, tho Magistrate gave judgment for plaintiff for w£3. ; ' DEFENDED ACTIONS, i In tlio defended case of Mrs. Louise i Outran v. Mr. E. C. Levvey appeared for plaintiff, while Mr. P. W. Jaclason appeared for defendant. '• ; \Judgment was.reserved in the case in which Young King sued Allan Orr and 1 Son to recover a sum of .£2OO, as damages . alleged to have been suffered in conse- • quence of a cart "running down" the plaintiff on his bicycle. Mr. E. (1. Jellicoe appeared for tho plaintiff while Mr. • A. H. Hindmarsh appeared for thp defendant. •IMMIGRATION RESTRICTION ACT. Mi. D. G. A. Cooper, S.M., was further occupied yesterday with tho hearing.of the case in which the Collector of Customs (Mr. E. R. Briibazon) is proceeding against two Chinese residents for breach of the Immigration Restriction Act. The defendants were named as Chan Yee Hop and his wife Van Chu Ling. The case of the female defoiftlaut is being decided first. Mr. P. S. K. Macassey, of the Crown Law Office, represented the Collector of Customs, Mr. E. G. Jcllicoe (instructed by Messrs. O'Regan and Dickson) appeared for tho defence, and tendered a ■>' plea of not guilty. ' ' The allegation was that in 1894 a Chinaman named Ah Young was naturalised in New; Zealand, and that' in 1895 Chan Yee Hop paid the poll tax in.New Zealand, but did not take out naturalisation papers; that Ah Young had since returnecl to China, leaving his naturalisation papers with a Chinaman in Masterton; that these papers had been secured by Chan Yee Hop, who went to Sydney, ■ married Van Chu Ling; and by making use of the naturalisation papers brought his wife into tho Dominion without paying JSIOO poll tax. '■ For the defence it was contended that the onus was on' the Crown lo prove that the female defendant wns not the wife of Ah Young, and that tho Crown had not discharged tlip onus. Decision was reserved. POLICE CASES. Mr. D. G. A. Cooper, S.M., also dealt with several police cases. Joseph Horbert Charlton, who wore the King's uniform, and for whom Mr. R. P. O'Leary appealed, was remanded until this morning on a charge of failing to account for email sums of money at Thames. .Tohn Williams Lucas pleaded guilty to a charge of theft of a case of jam, and. in view of his past record, was sentenced to two months' imprisonment. Clara Clark was convicted of being an idle and disorderly person, and was committed to the Salvation Army Homo for twelve months.
