AN APPEAL In the Supreme Court yesterday morning, His Honour Mr. justice Ilosking heard an appeal from a decision of the Magistrate's Court in the case, of the Inspector of Awards v. Henry Bodloy and Sons, dairymen. On May 7 last, Mr. D. G. A. Cooper, S.M., heard an information charging Henry Eodley and Sons with a breach of the Arbitration Act in that they failed to keep proper overtime books, and, after evidence had been tendered, the defendants were fiijed £1, with coats 7s. The defendants iicw appealed on the ground that the regulation .under which they were convicted was ultra, vires of the Act. Mr. T. Neave appeared for the appellants, while Mr. V. R. Meredith, of the Crown Law Office, appeared for the Inspector of Awards. ■ After hearing legal argument His Honour reserved decision. : UNDEFENDED DIVORCE. His Honour the Chief Justico (Sir Robert Stout) heard an undefended divorce case yesterday, when Laura Louisa M'Kenzie petitioned for dissoluof hor marriage with Francis M'Kenzie on tlig ground of desertion. The parties were married in Wellington on January 16, 1907, and the evidence was that the respondent had deserted his wife and failed to maintain her for a greater period than five years. A decree nisi was granted, to be moved absolute- in three months.
