AN ORIGINATING SUMMONS
Y.M.C.A. TRUST
In iho Supremo Court yesterday His Honour Mr. Justice Hosking heard an originating summons to determine certain questions of law arising under the trust created in connection with the Y.M.C.A. Building in "Willis Street. The parties to tho summons were: The Y.M.C.A., plaintiffs, and the City Public Works, Water, and Drainage Sinking Fund Commissioners and the Attor-ney-General, defendants. Mr. R. Kennedy appeared for tho Y.M.C.A., while, tho City Solicitor (Mr. J. O'Shea) appeared for the Commissioners. The Attorney-General was represented by. tho Solicitor-General (Mr. J. W. Saltnond, K C.). . Briefly, the Court was asked to say whether -there was power to mortgage tho property, and whether, in tho event uf 'a sale (after tho jnortgage), a purchaser would receive the fee-simple free, of tho trust? After bearing- legal argument, His Honour reserved decision. . UNDEFENDED DIVORCE. His Honour the; Chief / Justice (Sir Robert Stout) heard an undefended divorce petition in the Supreme Court yesterday morning.'. This was the case in which , Charles Edward Richardson asked for dissolution of his marriage with Minnie Richardson, on the ground of habitual drunkenness. ,The evidence showed that the parties were married in" Auckland on February 1, 1909, and had recently been living in Wellington. On account of being addicted to drink,the wife had for some time past neglected her domestic duties. His Honour granted a decree nisi, t'o bo moved absolute in'three months. Mr. A. H.' Hindmarsh appeared for the petitioner.
