From the facts set out in the stated case it appeared that on June 23, 1914, Thomas Morland as second sold to Bowron Bros and Co., Ltd.,"some 6030 acres of land near Wellington, known as the Happy Valley Estate. Tbe price was £35,000, and possession was by agreement to date from May 15, 1014. Later Bowron Bros, discovered that £88 17s. was owing oil tho land as graduated income tax levied to March 31, 1914 In order to protect the property, Bowron Bios, paid the amount, and then sued Morland to mover it. The Magistrate (Mi. H. W.
