CASE BEFORE A FULL BENCH
A! Full Bench of the Supremo Court sat yesterday for the purposg of bearing argument on law points arising in a case, which was commenced before a Judge and common jury in August last. His Honour tho Chief Justice (Sir Robert Stout) presided, and associated with him were their Honours Mr. Justice Edwards, and Mr. Justice Cooper. The original action was a claim for damages and an application for an injunction based upon' tho advertising of what was termed a "sale by mortgage." Particulars of tho claim wore published at the original hearing, when tho defendants submitted to the injunction but wero still required to defend the claim for damages. The plaintiff was Maurice Manthel, electrician, Wellington, and the defendants were Arthur Bolton, set tier, WellUgtoni; Walter Arnold Hawkins, Registrar of tlio Supreme Court, Wellington; and ]3. Johnston and Co., auctioneers, Wellington. On tho second day of tho hearing in August the jury had been dispensod with, and it was decided that the case should bo dealt with before a Full Bench. It came on yesterday, when the argument took tho form of a motion, by the defendants for a nonsuit.
' Mr. 0. P. Skerrett, K.C., with him Mr. W. L. Rothenberg, appeared; foi\ the defendants in support of the motion, which was opposed by tho plaintiff, who was represented by Mr. M. Myers, with him Mr. 0. C. Mazengarb. Argurfient concluded at 4.45 p.m., the Court reserving judgment.
