MAGISTRATE'S COURT
AN AGGRAVATED ASSAULT Mr. W. 6. Riddell, S.M., presided at yesterday's sittings of the Magistrate's Court, when John Lightfoot, recently a tablet porter at ■ Plimmerton Railway Station, pleaded guilty-to an aggravated assault iipon his. wife and to a further charge of damaging property. According to Chief-Detrotive Boddam -tho assault was tho outcome of domestic, differences, the 'accused having attacked his wife with a-' piece tof wood.:' She had been, removed 'to - the Hospital, suffering fromy, scalp, - wounds; and bruised shotildor, but she had, since 1 recovered. Mr. H. F. O'Leary, pleaded for leniency for the who'had never previously been, before the Court; .For the. assault ,the 'accused was convicted, and ordered to pay doctor's expanses, four : guiwjas, . and fqrj.causmg the damage he'''wis;^ne^,2Qs..'and!w4ered to make : good (lfis-). Default was fixed ,at 21 - (Jays' -imprisonment, but Lightfoot ' was allowed time to find the money. . " - •' INFORMATION DISMISSED. A young man, named Sydney Harold Bos, pleaded not guilty to,a charge of boing drunk while in .charge of a motorcar on Jervois Quay on September 20. He was defended by Mr. P. \V. Jackson. ■'- The prosecution was the result of a collision between a motor-car driven by Fox and an express driven by . David Williams. Three police officers, and the driver of the'express declared; that Fox was drunk after his arrest, but Fox denied that he was addicted to drink, or . that he was suffering from liquor on the occasion, and stated that«he had only had two drinks during the day. Several ..other witnesses gave evidence tor the defence. The Magistrate considered that there was some room for doubt as to the condition of Foj, who would be given the benefit of the doubt. The information would be dismissed. ALLEGED THEFT.' v t f rei J e ™k Xfeorgo Smith, alias George John Burberry, was committed for trial on a charge of"" theft of a cheque valued at £3. The evidence for the prosecution was to . the effect that the cheque was taken .from the office of Oscar Beavis, in Courtenay Place, on Septembe? 7, . and that Smith had been in the office to use the telephone. The - accused, who was not represented by'counsel pleaded not guilty, and reserved his defence. • -, ■ •' OTHER CASES. John M'Laughlan and William Wilkinsoii were charged Tyith.. creating a breach of the; peace by fighting in the public street: .- .The former was convicted and discharged, but who Appeared to have been more aggressive was fined 215., .the/alternative being three days' imprisonment. . John Shepherd was ■ convicted and discharged for drunkenness, but was fined £5 on a charge of indecency. In default of payment, Shepherd is to undergo three weeks' imprisonment. '• • Fortunatus Evelyn Wright was committed for trial on -two charges of indecent assault in Wellington in July last. James Smith, for drunkenness, was fined 205., the alternative being throe days' imprisonment. Two first-offend-ers were remanded for medical treatment, and a third was leniently dealt with.
