SHIPPING COMPANY'SAPPEAL DISMISSED, By Telegraph.—Press Association. Auckland, September 17. Mr. Justice Hosking dismissed the appeal by the New Zealand Shipping Company in the action wherein Wilson and Horton wore awarded £101 damages in respedt of the loss on rolls of paper brought from Montreal to Auckland by tho steamer Knight of the Garter. His Honour said the Court was concerned only with tho question whether a prima facie case had been made out that the structure erected to cover the doorway of the compartment in which the paper was stowed was unfit at the commencement of the voyage. and whether there was sufficient evidence of that fact to go to tlie jury. 'He thought there was ample evidence, and dismissed the appeal with costs to be paid by appellants to respondents. .
