PROTEST BY COUNSEL (By Telegraph.—Presß Association.) Duneditli Septesber 9. The case partly heard on August 19, before Mr. Widdowson, SiM., 'in which the Typographical. Union , sued. - tho "Otago Daily Times" and ' Witness" Company for £10, for alleged breach of award, was proceeded with this moaning. The case involved payment to ope-ators for blocks. At the outset, Mr. Callan, for the union, handed the Magistrate a written protest against the Magistrate having, since the liist- hearing, usited the "Times" linotype room, accompanied by Mr. Fenwick. Counsel claimed that lie should have been notified; he submitted it was unfair that one party should not have had an equal opportunity with the other of explaining the works, and directing attention to points supporting its own contention. / , '
After reading Mr. Callan's protest, Mr. Widdowson said ho had learned nothing about contentious matters as the result of his visit to the "Time?" office. A representative of Mr. Callan's clients was present, and Mr. Fenwick explained nothing of a contentious nature.! He thought it a most unwarranted position to take up, because he was most careful not to seo or ask about anything. contentious. The case would have to begin de novo, before Mr. Bartholomew. He (Mr. Widdowson) had never had a suggestion of this kind made against him before. He thought it was unwarranted, in any shape or form.' _ Mr. Fenwick expressed the opinion that.Mr. Callan's action was most unfortunate and uncalled for. Never by I word, implication, or suggestion was anything 6aid or shown, to Mr. Widdowson that could be construed into prejudicing the case. .It was just such an investigation as Mr. Callan had, and was made at his suggestion. Mr. Widdowson said one of tho roasoris why he had Mr._ Hooper (Clerk of the Court) accompanying him, was that' the visit should be all right. . _ The case was then adjourned sine die.
