CLAIM BX OFFICIAL ASSIGNEE. Before His Honour the Chief Justice (Sir Eobert Stout), the caso was taken of the Official Assignee at Napier v. Patrick Joseph Griffin (of Wellington), Charles Tricltlebank ■ (hotelkeeper, Waipawa), and William Isaac Limbrick (commission. . agent, Waipawn). P. P. Kelly' appeared for the Official Assignee, Mr. J. J. M'Gratli for the defendant Griffin, and Mr. Wed<Je for the defendants Trickleba-nk and Limbrick, It appeared from the pleadings that in 1912 Griffin leased the Imperial Hotel, Waipawa, at ,£2O a week, to one Sidney AtIrin Moore, for a term of five years. In Jdmiary, 1914, Moore authorised Limbrick to sell his interest in tho hotel for ,£I6OO, and the lease was sold to Tricldebank for ifilGOO, Griffin, consenting. The day after tho money had been paid over Moqro went bankrupt, and the Official Assignee claimed that the money should go for the benefit of the creditors. The total amount involved was JG1702.
