AN INDUSTRIAL CASE
IMPORTANT POINT RAISED. (By Telegraph.—Press Association.) VVanganui, August 18. A very important point was raised at llio hearing of an industrial case in tho Magistrate's Court this morning by Mr. Cohen, bounsel for the a luirmaid, charged with refusing to join tho Hotelworkcrs' Union when requested. Mr. Cohen's main point was that this award practically amounted to compulsory trade unionism, a condition of affairs not- contemplated by tlie Legislature. The award was mado from tho recommendations of the Council of Conciliation. which the parties agreed to accept, and was sanctioned by tho Arbitration Court without discussion. . Barmaids who were not members of any association or union were prevented by law from participating at tlio Conciliation Council in any discussion, concerning tho award to which they were made parties. The Magistrate (Mr. Kerr) said ha must hold the award binding until it had been proved otherwise, and gavo judgment for • plaintiff. A fino of £2 was imposed. Appeal is to be mado to the Arbitral lion Court on the point raised by Mr. Cohen. The point of the appeal afIccts a numbers of awards made in a similar manner.
