DISPUTE ABOUT AN HOTEL
A dispute concerning the W'airau Valley Hotel was heard by Mr. J. W. l'oynton, S.M., in the Magistrate's Court yesterday, Alfred Gustofson, publican, of Wellington, claiming from Alice Mary Addison, hotelkeeper, of the Wairau Valley Hotel, £50 in this respect. Plaintiff alleged that on April 20, 1915, ho paid to defendant £50 as a deposit on account of the purchase from defendant of tho lease of the hotel in question. Plaintiff alleged that defendant was or entitled to any lease of the hotel, and was therefore unable to sell the property. Plaintiff accordingly claimed v. return of tho deposit. As an alternative cause of action plaintiff claimed the same sum, alleging that certain other representations made by defendant in respect to the property were untrue. After healing the evidence, the Magistrate reserved his decision. Mr. 0. Becre appeared for plaintiff and Mr. A. W. Blair for defendant. AWARD CASES. (Before Mr. J. W. l'oynton, S.M.) A breach of the Wellington Dairy Employees' Award was alleged against Henry Bodloy, dairyman, of Wellington, in that ho employed a van driver and stableniau (Arthur Beacock) for more than five hours on a Wednesday, contrary to tho provisions of the award. Mr. William Slaughter, Inspector of Awards, prosecuted, and Mr. T. Neave defended. Mr, Slaughter said that while defendant carried out tho spirit of the. award ho had failed to give the prescribed half-holiday on Wednesday. Mr. Neave submitted that there had been no breach, as the half-lioliday had been arranged for Beacock on tlie Sunday. The Magistrate -said there had only been a technical breach of the award, and imposed a penalty of 205., with costs. . The Inspector of Awards (Mr. William Slaughter) proceeded against T. S. M'Guire, licensee of tho Imperial Hotel, for a £10 penalty in respect to fi breach of the Hotel Workers'. Award, in that he (M'Guire) had failed to pay nil eniployee 7s. Gel. per week in lieu of providing lodging, and had paid ss. per week instead. Mr. ,_W. Perry explained on defendant's behalf that he had only followed the practice of tho former licensee of tho hotel, who had paid the same amount to the same employee. Defendant was unaware that he was committing a breach cf the award. Under the circumstances tlie Magistrate imposed a penalty of £3, representing the sum that defendant should have pa>d his employee. Edward Alcock, the employee referred to in the previous case, was fined £2 10s. for accepting less than the sum prescribed by the award in lieu of lodging. DEFAULT DEBTORS' LIST. Morris. £8 25., costs £1 17s, t JUDGMENT SUSIMONSES. Ernest William -Biggs was ordered to pay Skeates and White £8 13s. Bd. by instalment of £1 a month, in default mne days' imprisonment; M. .J. Hasler was ordered to pay Gordon and Gotch, Ltd., £8 125., at tho rate of £2 a month, in default nine days' imprisonment; James Woolford was ordered to pay Charles Horace Couchman £11 12s. bd. by instalments of 2s. 6d. a week. 1 OTHER CASES. J. 0. Cooper, apiarist; of Papawai, proceeded against the New Zealand Poultry Industries, Ltd., for £6 2s for a quantity of honey alleged to have been supplied to defendant, and which defendant had not paid for. After hear'"Sthe evidence the Magistrate (Mr. ;!• S.M.) gave judgment for plaintiff for £6 2s„ with costs £1 ? S; B- a ' r appeared for plaintiff and Mr. H. F. Ayson for defondant. In the disputed case of William Lingard (trading as W. Lingard and Co.) v. Mil est, Beauchamp Hare (trading as li. B. Hare and Co.), judgment was given for plaintiff for tlie amount claimed £25, with costs £6 12s. 6d. At the hearing of the case, Mr. Douglas Jackson appeared for plaintiff, and Mr. 1. Neave for defendant. POLICE CASES. (Before Mr. D. G. /A. Coopor, S.M.) . A young man named Henry Francis M Ilroy was remanded to Wednesday next on a charge of stealing £4 from the person of John Edwards. On the application of Mr. H. F. O'Leary accused was allowed bail in £25. Peter Mikkleson, who, when-he was being arrested for drunkenness damaged a constable's helmet, was ordered to pay the cost of the same, 9s. 6d., in default 48 hours' imprisonment. On tho charge of drunkenness, he was fined -10s.,'with the option of seven days' detention. -■•May Houston was convicted and discharged on a charge of drunkenness, and sent to the Salvation Army for a period of six months, on a charge of being a roguo and a vagabond. Patrick Brosnalian was convicted and discharged on a charge of-drunkenness, and fined 405., in default seven days' imprisonment, for indecency, in Cuba Street. For drunkenness, John C-anolan was fined 10s., with the alternative of 48 hours' imprisonment. Four first-offend-ing inebriates were dealt with. PIMPLES. PIMPLES. PIMPLES.
