COURT OF APPEAL

PUBLIC TRUSTEE'S COMMON FUND The Court of 'Appeal (first division) sittings wero continued yesterday, when the Bench was occupied by Their Honours tho Chief Justice (Sir Robert Stout), Mr. Justice Denniston, Mr. Mr. Justice Sim, Mr. Justice Hosking, and Mr. Justicc Stringer. Reserved judgment was delivered in tho case of the Public Trustee v. tho Hutt Iliver Board. The appeal was from ii judgment of His Honour Mr. Justice Edwards, who recently decided the important point that the Public Trustee's Common Fund is not money belonging to tho Crown, that when money from that fund is invested in land then the land in question is not to be , deemed the property of tho Crown, and consequently the Public Trustee is liable for the rates levied by the local' authority on such land. :At the hearing, Mr. C. P. Skerrett, K.C.. with him Mr. F. E. Kelly, represented the appellant (tho Public Trustee), while Mr. T. F. Martin, with Mr. E. P. Bunny, appeared for tho Hutt River Board. The interests of the Crown were looked after by tho Solici-tor-General (Mr. J. W. Salmond, K.C.).

The appeal was unanimously dismissed with costs on the middle scale.
