CIVIL CASES . ALLEGED BREACH OF AWARD 1 - Mr. D. G. A. ,Cooper,presided' at yesterday's sittings of • the Magistrate's Court. Hearing of civil .actions extended until late in the afternoon. The Labour Department - : proceeded .against Charles Guy, an employee of the Wellington Milk Company, to recover the, sum of £2 as penalty-for an alleged "breach of the. Milk Vendors' Award." -The - Inspector of Awards (Mr; W. Raplo.v) appeared for the Depart 7 ment, while Mr. A. W. Blair appeared for the defendant. ■ The 'alleged breach consisted in tho employment of a boy,', (James- Martin) at less than-award'rates.. The facts, which .were admitted, wero that, defendant employed the lad for "a few hours to assist himaw the delivery - 4 of milk, and for ; this assistance the lad was paid 4s. per week. - It was contended for the defence that tlie defendant not an employer, and therefore not a party to tho award. . , After,. hearing argument tho Magistrate reserved decision. 'A GAME' OF, POKER. ' ; Sidney. O'Brien, a'sphalter, • / of, Wel-'-linnton, sued Tom Tremayne, jeweller's assistant, of, Hamilton, to' recover. the slim, of £5 17s. Gd., {value of a disiion-. oured bill (£5 125.) and interest (ss. 6d.), due on the same from the date of dishonour. Mr. J. J. M!Grath appeaxed for, the plaintiff, whi'i Mr, P. H. 'Putnam appeared for the defendant, j Ihe debt (according to the evidence) was ,incurred during the progress of a game of poker at a prixate residence in t,Aro Street," the position at the end of tho game being that the defendant owed O'Brien the sum of. £5 125,, for which he gave a p.n. '.;' ; After hearing the evidence"the Magistrate gave judgment for the plaintiff for the sum of £4 2s. andicosts. ' WAGES "CLAIM. . ' Judgment was given for plaintiff for the sum of £9 155., with costs. £1 16s„ in the case of Fred. Rosson v. Margaret Smith, a claim for 1 wages. Mr. G. Samuel appeared for the plaintiff, while' Mr. A. H. Hindmar-sh represented the defendant..

ivitli, or undergo three days' detention in the Auckland Gaol; POLICE BUSINESS. Charged with' being an idle anil disorderly person, Lottie Caseley, was convicted and ordered to come up for sentence when called upon. It was made a condition of her release tliat _ she should leave tho nndesirahle locality in which she at present resided. George Miller was fined £2 for drunkenness, the alternative being one month's imprisonment. On a similar charge,' Joseph Reginald Harding was fined 10s., in default to undergo 48 hours' imprisonment. Two first_ offending inebriates were also dealt with. George Horace Marshall, who described himself as a farm labourer, was charged with failure to comply, with an order for the maintenance of his wife and three ohildren. Mr. J. F. W. Dickson appeared for the complainant, while Mr. J. J. M'.Grath appeared,for the defendant. After hearing evidence" to tho effect that Marshall had. made no attempt to comply with the order since his discharge from Wellington Hospital 111 January last, the Magistrate imposed a sentence of one month's imprisonment, the order to be suspended so long as future payments aro. made and tho the slim of 2s. per week raid off the arrears, which were reduced to ■ £20. Marshall was also ordered' to pay £1 Is. solicitor's fee.
