SUPREME COURT

A BANKRUPTCY CASE In tho Suprome Court yesterday morning, His Honour Mr. Justice Edwards dealt with an originating summons to determine a question arising in connection with the bankrupt estate of James Shaw, storekeeper, late of Rewa, near Feilding. The plaintiff in action was the Deputy-Official Assignee, Palmerston North, and the defendant was the Bank of New Zealand. Sir Francis Bell, K.C., with him Mr. M. H. Oram, of Palmerston North, appeared for the Assignee, while Sir John Findlay, K.C., with him Mr. 'I'. Neave, appeared for the Bank of New Zealand. James Shaw was adjudicated bankrupt on his own petition on April 27 last. Ho -had been working on an overdraft at tho Bank of New Zealand and 011 April 3 it appeared he had instructed his solicitors to pay to the bank the sum of £471 6s. in reduction of tho overdraft. This was done, and tho Doputy-Official Assignee now asked that the paymont should be declared void on tho ground of fraudulent preference. Several affidavits had been filed in connection with <he case, and evidence was tendered yesterday by tho managor of the Bank of New Zealand at Feilding. The case was then adjourned fo rtlirce weeks to enable tho DeputyOfficial Assignee to be called. Tlio defendant (Bank of New Zealand) was allowed ten guineas costs for the day.

Mr. S. George Nathan is offering for sale this afternoon, in tho Chamber of Commerce, Mr. Bowie's residence, situated at Karaka Bay. On Wednesday next Mr. Nathan is offering Dr. Tolhurst's freehold property, situated at the Courtonay Place tram terminus. On Friday at 2 o'clock a sale of five pianos will be held by Messrs. A. L. Wilson and Co., at their rooms, 151-153 Lambton Quay. The various makers are "Brinsmead" (almost new), "Bohm," "Koch," "Imperial," "Hoffman," and "Brasch." The pianos may be viewed at the auctioneers' rooms. To-day at 1 p.m. Messrs. C. W. Price, and Co. will sell, on the promises, 121 Upper Willis Street, household furniture and costiy carpet squares and other appointments, in the estate of the late Mr. Folk Cohen.
