LICENSEE AND BARMAN CHARGED
ALLEGED DRUNKENNESS IN
CITY HOTEL
Another stage of tho City Hotel caso was reached yesterday afternoon, when the hearing of evidence in the case in which Marshall John Donnelly was tvT\V H ,T ' 1E , 1 -' quor Charles will ,e r aU ?n licensed premises, \\ etherall being already intoxicated, was continued A further charge of permitting drunkenness in the City Hotel was also preferred. John Maher, barman at the City Hotel, was also charged that, not being ™ licensee, he did supply liquor to C S. \\ etherall, tho latter being already intoxicated. ~ C J - f- M'Grath, who appeared for tho defendant, submitted that the case against the licensee should bo dismissed. Donnelly bad no knowledge of the alleged act. Maher, the barman, had sixteen years' clean record, and if any oftence had been committed it was lie ' who had innocently committed the acl Maher was not aware that Wetherall was drunk. The latter had previously been warned by a sergeant to go home Counsel submitted that this was proof that Wetherall was not drunk enough to be apprehended. As soon as he had ordered a drink the police intervened. After Inspector Hendrey liad addressed the Court His Worship reserved his .decision. POLICE CASES. For having been found drunk, Mary Jane Saunders was lined 10s.; for having, as a prohibited person, entered a hotel, £1; and for having used obscene language, £3. . Frank Garland was fined £1 for having been found drunk while in charge of a horse and vehicle. A fine of £1 was _ entered against Sydney Saunders for insobriety. Charles Spurway, carrier, charged with haying used obscene language at tho Thorndon Railway Station on April 1, pleaded not guilty. After evidence had been heard defendant was fined £2 aud costs. CIVIL PROSECUTIONS. LAXITY IN SOHOOL ATTENDANCE. For failing to send their children to school, Alfred Bradley, John Johnson, Ernest Thomas Kriete, Richard J. Lloyd, James Mulholland, Marv White, and Arthur Whittington were fined ss. each with costs 7s. BREACH OF ARBITRATION ACT. A breach of the Arbitration Act was preferred against' Henry Bodley, dairyman, in that ho had failed to keep overtime books. After evidence had been heard His Worship fined defendant £1, with costs 7s. A "MOVIE" DISPUTE. Before Mr. W. &. Riddell, S.M., a case was_ heard yesterday in "which Ernest Hickey, film supplier, - proceeded against the Thompson-Payne Picture Company of Napier for £23 2s. 2d. for postage on films, interest on moneys alleged to be owing by the defendant company to tho plaintiff, and printing for picture programmes. Mr. J. J. M'Grath, who appeared for defendants, raised a nonsuit point, holding that the claim had not been proved, and also that it was too indefinite. His Worship upheld the point, and plaintiff was nonsuited, with costs amounting to £3 14s. 6d. Mr. W. Perry appeared for the plaintiff. BREACHES OF BY-LAWS. _ For various breaches of by-laws penalties were imposed upon the following H. C. Belworthy, George Bradley, Joseph Bruton, Leonard Cain, Henry Olason, Claude Cornforth, Patrick Daly, Arthur Dell, Robert Allan Hallet, Leigh Hunt, Edward Levy, Thomas Murphy, Edward B. Parsons, John Phillips, Honoro Whelan, WilHam Percival Whitten. MISCELLANEOUS OASES. Isodore Abel, a Senior Cadet, was fined os. with 7s. costs, or 48 hours' military detention, for having failed to discharge his military duties.
For a breach of the drainage regulations, Emma Stannard was fined ss. and cost's 7s.
