MAGISTRATE'S COURT
FLORENCE YOUNG TOUR ANOTHER CIVIL DISPUTE. Another civil action arising out of the recent Dominion tour of the Florence Young Company was heard by Mr. W. G. Riddell, S.M., in the Magistrate's Court- yesterday, when Reginald Roberts and Claude R. Bantock, at present members of the Wellington Oporatio Artists and members of the Florence Young Company, proceeded George Stephenson and Alfred Linley, theatre proprietors, for the sum of £35 18s. 3d. Mr. P. AY. Jack6on appeared for plaintiffs, and Mr, W. Perry for defendants. In the statement of claim plaintiffs olaimed the sum of £35 18s. 3d., being the balance of one half the cost of steamer fares from Sydney to Christchurch, and from Wellington to Sydney for plaintiffs and other members of the Florence Young Company, agreed to be paid by defendants under contract for the tour of New Zealand, less certain amounts received. Defendants counterclaimed for £30 Bs. lid. expenses alleged to be incurred by defendants and their servants during the Dominion tour, and agreed to be paid for by plaintiffs. Tho evidence in the case, which was considerable, showed that tho tour of tho company had been a loss, and that there had been disagreements between tho promoters (defendants) of the tour. It was alleged by tho defendants that the contract between- plaintiffs and defendants had been broken. Air. Perry held that as the contract had' been broken in the middle of the tour, defendants were therefore not liable for plaintiffs' fares to Sydney. After hearing the evidence the Magistrate reserved his decision. POLICE CASES. Mr. W. G. Riddell, S.M.. dealt with tho police cases at the Magistrate's Court yesterday morning. George Hy. ITampson, who was arrested by Detective Dempsey on Tuesday, was charged with assaulting two girls, aged 10 and 11 years respectively. Oil the application of Chief-Detective Boddam he was remanded to "Wednesday next. Mr. H. F. O'l.eary applied for bail on behalf of the prisoner, nnd tliis was fixed at £50.
Charles. Coombs, a seaman off the Blenheim, was charged with assaulting the chief officer of that vessel, John fires Owen. He Was fined '10s., in default seven days' imprisonment. •Tamos Patrick O'Brien, charged with helpless drunkenness at Paekakariki, was remanded for a week for enrativo treatment. One first-offending inebriate was convicted and discharged.
