C. N. BAEYERTZ'S LIBEL ACTION. (By Telegraph.—Press Assn.—Copyright.) (Rec. March 22, 9.5 p.m.) Sydney, March 22. Charles Nalder Baeyertz, editor of "The Triad," is suing the proprietors of the "Theatre Magazine" for £1000 damages for an alleged libel contained in a paragraph referriiij* to the plaintiff's "Triad" criticism of Miss Elsie Spain. Plaintiff contends that the paragraph inferred that lie was . a German. The defendants pleaded not guilty. Baeyertz submitted that the alleged libel was contained in the following paragraph: "That unconscious comedian of culture, Nr. C. N. Baeyertz, accuses Miss 151 sio Spain of making 'era' of all her 'ors.' This is very painful and ridiculous. It is strange that TTerr Baeyertz, of all people, should lodge a complaint, as he suffers in spelling what he alleges of the English girl in song." Plaintiff's counsel stated that early in 1914 the plaintiff came to Sydney to arrange for the publication of an edition of his paper, hut the project had been suspended, owing to the war. The "Theatre Magazine" attacked the plaintiff personally, affording evidence of malice. Plaintiff contended that his criticism of Miss Elsie Spain, was'unobjectionable.
