A LICENSING CASE. In. the Supreme Court yesterday morning His Honour Mr. Justice Chapman delivered reserved judgment on an appeal from the decision of Mr. J. W. Poynton S.M. in a Levin licensing case in which John Bagrie was informant and Matthew J. Suhan licensee of the' Levin Hotel, defendant. . 1 Suhan was charged with unlawfully, keeping his premises open for the salo : of liquor at a time (10.30 p.m. on July 21 1913) when such premises were required by law to be closed. _ The Mag- _ istrate, after hearing the evidence, die-" missed the information, ; and the Crown 1 ;, now appealed against this decision on the ground that it was erroneous in law,
At-the hearing Mr, H.'H. Ostler, of the Crown Law Office, appeared for the Crown, while Mr. T. M.Wilford appeared for the respondent. His Honour allowed the appeal, remarking that _ the t whole case pointed to a transaction in the nature of a sale or air intended 6ale, and the opening of the premises for the purpose of supplying.liquor pursuant to that sale. The case was accordingly remitted to the Magistrate to be dealt with accordingly.
