, - — MAGISTRATE DECLINES' TO DEAL • WITH THE CASE. (By Telesrapli.—Press. Aojoci«.ll»B.> Craymouth, March 15. Mr. Hewitt, S.M.. refused to deal witli the information against a Territorial named Gibbons, charged with assaulting and causing bodily I:arm to Neil Poarce while in the training camp at Totara Flat. He contended that while he had jurisdiction, the case was ono purely of a military offence, and did not come into the category of those that should be referred to the civil' court.' Counsel for defendant submitted that the military authorities, having handed the defendant over to the civil power,could not now deal with him. As regards the alleged bodily harm, counsel stated that Pearce's jaw was not broken, as at first alleged, but lie had since been operated on for an abscess at the root of a tooth. Accused was subsequently arrested on a warrant- issued by Colonel Richardson, and will .be handed back to the military authorities.
