PRIVY COUNCIL APPEAL

"UNION S.S. COMPANY V. HARBOUR BOARD. By Telegraoli—Fresa Association—OopyrleU London, March 9. In the Privy Council case, Union Steam Ship Company of New Zealand v. the Wellington Harbour Board, the appeal was dismissed with costs. Their Lordships varied tho order of the Court below.

[On February 10 last, it was reported by cablegram that the Privy Council had reserved judgment in tlio case Union Steam Ship Compajiy versus the Wellington Harbour Board, aud that the respondent was not called on. The point involved in the originating summons brought by the Harbour Board was whether the Union Steam Ship Company, by reason of a mail contract with the Postmaster-General, Mas exempt from all duss to the plaintiff board in respect of the defendant company's vessels engaged in the service and extension of the port of Wellington, <jr exempt from part only of such dues. His Honour the Chief Justice (Sir Kobert Stout), , at the hearing in the Supreme Court of New Zealand, held that the company's steamers were liable to pay dues until the mails to lie carried under t'ho contract wero received on board. Against this decision tnu company appealed, but the appeal wac dismissed, with costs on the highest scale. Leave to appeal to the Privy Council was granted, aud it is this e tipcat that has now been dismissed, ai though the order of the Supreme Court lias evidently been varied.!
