IMPORTANT JUDGMENT -- e TOTALISATOR INVESTMENTS. (By Tele^ra-ph.—Presa 4 Association) Christchurch, January 26. An important judgment was delivered at Oxford by Mr. Bailey, S.M., "Bearing upon totalisator investments. The case was one in which William Fenwick sought to recover from Keith Giinn the sum of £26 95., alleging that lie gave Gunn £2 to invast on a horse at the New Brighton trots. The horso won, but Gunn only paid over the dividend on ono £l ticket, returning the remaining £1 to plaintiff. Defendant contended that the matter was to bo left to tho owner's discretion, and the latter had only invested £1. Mr. Bailey held that it was established that only £1 had been invested, and plaintiff could not succeed. He also held that as the transaction between plaintiff and defendant was illegal, plaintiff could not recover under Section 53 of the Gaming Act, 1908.
