Judgment ha.s been given by the Arbitration Court in an interesting compensation claim heard at Oamaru recently. The plaintiff (Smith), a painter and paperhanger, was engaged to work, for the defendant (Frith) at a place three miles from Oamaru Post Office. By the terms of the award plaintiff's employment began when he reached a point a mile and a half from work and ended when he reached the same point on Jiib way home. While plaintiff was returning from work and before reaching tho point at which his employment ended, the bag in which he was carrying his lunch got between his knee and. the handlebars of-his cycle, causing Kim to fall and fracture an arm. The .defence denied liability on the ground that tho accident did not arise "out of his employment." Tho Court, in its judgment, said the case was complicated by the faot that plaintiff was carrying a bag on a bicycle which was the cause of the accident, but it was reasonable that he should carry his luncheon in such a bag. The case was on the border lino, but the Court was of opinion that the accident arose "out of his employment," and plaintiff was entitled to judgment. Plaintiff , had been able to do light work for some time past and was awarded half wages from the date of the accident to October 12, 10a. weekly from October 12 to December 15. Defendant was also declared liable to pay 10s. weekly from that dato. according to the piovisions of the Act. It pays to check your baggage through ns.
