! A SAMPLE OF MILK ; NOT UP TO REQUIRED ' STANDARD Mr. D. G. A. Cooper, S.M., presided '• at yesterday's sittings of the Magistrate's Court. '* A charge of selling adulterated milk ■ was preferred against Cole, Crump, and Cunuy. Mr. H. H. Ostler appeared for tho Health Department, - and Mr. M. - Myers for the defence. A plea of not guilty was entered, counsel for the defence intimating that the plea would be' ! withdrawn. later in the case. Inspector Middleton, in giving evi--3 dence for the proseoution, said tlat on - September 30 last ho purchased a sample of milk from one of the dei fendant company's carts. To Mr. Myers; Witness admitted that there was 110 suggestion in the present case that anything Lad been added to the milk, only that it was deficient in j certain properties. Mr. Myers explained that the object in pleading not guilty was to show the Magistrate that tho merest, nominal penalty should bo imposod. After colling one of the members of - the defendant firm to give evidence, Mr. Myers withdrew the plea of.not guilty, Mr. Ostler submitted that in bucli a case as the present one, where (such a. large quantity of milk was sold by j the defendant company daily, the pen-' j alty should not be such as had boon proposed. 1 ■ The Magistrate remarked that tho case was not so grave as others that had como before the Court. A,fine of £5 would be imposed, with costs, £1 18s. Gd. ; CRtJELTY TO SHEEP. A charge of cruelty to a uumber of sheep was preferred against E. J. Mann. - The action was taken by the Society for tho Prevention.of Cruelty to Animals, the charge laid reading "that defendant caused 76 sheep to be conveyed in such a manner on October 31 last as to subj ject them to unnecessary pain. and suffering." i, Sir. V. R. Meredith appeared for. the prosecution. Defendant conducted -his > own case. _ "Tho condition of the. sheep showed a great want'of thought on. your part," remarked ' the - -Magistrate, after hearing the evidence-. "However, 1 I' will not treat it very bad case." A fine of £2 with costs, £2 os. 6d. was C imposed. , ', : 0 ... OTHER CASES,' Two young men, William Garrett and James Ferguson, who recently had a ' stand-up fight in the public street at Johnsonville, were each charged with using threatening behaviour and creat-, iug a breach of the peace. Mr. F. E. . Petherick, ■ who. appeared for the ac- ' cused, asked the Magistrate not to , record a conviction against either of the youths, as both were of respectablo : families and had been punished sufficiently .already.' The Magistrate.adopted counsel's suggestion, and cautioned and discharged iach of tho accused. Jean Dakiel, who was discovered begging in Courtenay Place 011 Thursday night, and who has been previously convicted for being idle and disorderly, was charged with being a rogue and a vagabond. She pleaded guilty and was sentenced to three/months' imprisonment.' 1 Oliver Rowland Randall Wiggs appeared on remand charged .i|ith deserting his wife, in New South Wales. Mr. H. F. O'Leary appeared for accused, and applied for ■ bail, which was allowed iu £50. . \ . INEBRIATES. , " Frank • Adair (prohibited), appeared on ■ reman'd .charged with druukenness. Mr. H. F. O'Leary appeared on-his behalf, and explained that' accused, intended to leave, for-'Sydney by the next boat, and accordingly asked tile Magistrate to convict him. and order liiin to pay expenses - only.' The Magistrate agreed to/this, and ordered Adair ' to, oouie up for sentence wheii called upon, if lie paid £1 16s. medical expenses. For drunkenness, .Herbert ■ Wynne. Williams /(prohibited) .was, sent to gaol for a month, Chas, W. Hine and Henry -Stanley were each fined, 205., the option being, three days' imprisonment: and Jas. Houston, fined 10s., or 48 hours' imprisonment. Donald M'Gilvray, charged with helpless drunkenness, was ordered to ' pay 17s. 6d. medical ' expenses, iu default to undergo 48 .hours' imprisonment. Fredk. Kingan, charged with, drunkenness, was remanded for a week for curative treatment.. ' MISCELLANEOUS. Henry Moßton (Inspector of Awards) proceeded against Sing On Tie-. B:os._fcr' selling cigarettes' after, 8 o'clock. Mr: J. J. M'Girath appeared for accused, and entered a plea of guilty. As defendants had been previously beforo the Court on similar charges, a fine of £2, I with costs 75., was imposed. •Frank. Boffa, a hairdresser,, was fined £2, with costs 75., for failing .to, keep a wages and overtime book. A similar penalty was* imposed 011 A. S. Duncan for failing to close his shop at 1 p.m. on the statutory half-holiday. A number of shopkeepers were fined for Suuday, trading. Gertrude Bonnott, Charlotte Davies, and Robert Jamieson were each fined os., with costs 75., while Julia Callingham, Leonard Francis Kearney were each fined 10s'., with costs 7s. Rubia Dillon was ordered to pay costs, 75., while Rose Dillon was convicted and discharged. Neil Austin and 1 Esther Austin were each fined £1, with, costs 75., . , A number of defaulting ' Territorials were dealt with.
