Mr. Poynton,' S.M., gave judgment on Tuesday in a case affecting a nurseryman's'liability for trees not growing. Plaintiff was a local nursery firm, A. M. Wighton and Co., who claimed £31 15s. from R. Hannah for shelter trees, supplied and planted by plaintiff. Points in.dispute were scale of prices charged, skill employed in planting, and whether there was a guarantee. . His Worship held that the prices were reasonable in comparison with other firms' catalAgues, but that a guarantee was given . that a fair percentage would grow. He considered 75 per cent, would be a fair per cent;, considering the exposed position, and reduced the claim on that basis. He also reduced the f amount claimed for labour.
