PRIME MINISTER FIRM EDUCATION BQUNDARIES COMMISSION AGREED UPON y LOCAL RAILWAYS ♦ The Legislative Council sat at 2.80 p.m. The Local Railways Bill was com-' mitted. ■ , The Hon. H. P. Wigram raised the point on Clause 5, which enumerated tho disqualifications for membership on the Railway Boards, that it seemed possible that one of the disqualifying sub-clauses -would to persons through whose land the line was put, and yet it might bo' desirable that an owner of such property should be a member of the board. The Hon. H. D. Bell: I moye that the clause be postponed. This-was agreed to. ' On the motion of the Hon. H. D. >Bell, the Council deleted Sub-clause 3 of Clause 43, -which pertained to the | levy of the rate. .-■'..'." / Tho following-'proviso was added, to the sub-olause dealing with the amendment of the. classification list:—"Provided further that no amendment of the classification list shall'affect'the incidence of any special rate or rates theretofore made and appropriated and pledged as security for the repayment of a loan, and the transfer by any such amendment of any land from one class to another class shall Have effect only with respect to liability to rates other than such special rates.'-5.. , '- ..' Clause 50, which provides that ah Order-in-Council may be issued: authorising the construction' of a railway by a board,'had the following sub-clause addedfo it:—"The issue'of an Order-in-Council shall be conclusive proof for all , purposes that all proceedings, matters, and'things required by this Act, prior, to the.issue of such Order-in-Oourioil, have v been duly taken, done, and i fulfilled." Provision was made that where the land required to be taken comprised lands, owned by Natives, fitting notice of the intention should be given in the Maori "Gazette." Clause 54 provides that "on the issue of an Order-in-Council a board may construct and maintain a Tailway. The ■Council added to-it the following subclause:—"Tho board may enter into any such contract with the Minister of Public Works, and the, Minister of lic Works is hereby authorised to mako any such. contract with the board for the. construction or maintenance of railway .by the Department of Public ■Works at the costs and charges of. ih N board or for any such.purpose or matter as is referred to in Sub-section One hereof.? , Y \. , ... It was decided, also, to add to theBill a provision that a board would be a local authority for all the purposes of the Publio Works Act, 1908, and the railways and all works which the board is authorised by this Act to undertake would be deemed to be public works within the meaning: of that Act; : Consideration of. Clause 98," providing • for the recovery of .fines, was postponed. The Hon. Mr.. Bell said that he did .not,-;think .there ..was, any. need for the claiiso. '"-.
