Cooper, S.M*. presided over yesterday's sitting of the Magistrate's Court., . _ A sentence.-'pf one month's imprisonment (to bo served in the Auckland' Gaol) was imposed on Wm. Joseph Dywer, who pleaded guilty to a charge of attempting to obtain from Alice Goodman the sura of £3. by. means of a valueless cheque. . The prisoner was' remanded to ap- ' pear at Auckland on Friday next on the following charges:—(l) On May 23, at Auckland,'obtaining £5 by means of a valueless cheque'- from Fred. Charles .Bass, of the Rising Sun Hotel: (2) theft, on Juno 6, at Auckland, of a horse and cart, valued at £15 10s., -the property.of Abraham Bowden. OTHER CASES. :. .' William Edward Hughes was fined£2 for committing an objectionable act. tic was convicted and discharged for drunkenness.-. On a similar charge, James Nugent, who had received injuries to his head, and remembered nothing about the ounuce, was convicted, and fined £2, and was ordered to pay medical expenses, £2 ss. 6d., in default, one month in gaol. . Ten iirst-olfoncling inebriates were leniently dealt with.. For a breach of his prohibition order, Wm. Colsoil was fined- £1, in default, seven days' imprisonment. : SEPARATION AND MAINTENANCE. The application of Edith Isahella Elliott for separation from' her husband, Leonard Wm. Elliott, ( pn the grounds of persistent cruelty, wa"s granted. The defendant was ordered to pay 255. per week towards the maintenance of bis wife and two children, .... For disobeying a maintenance order in arrears to the. extent of i' 7, and medical expenses £6 65.,' Alfred J. Choto was sentenced to fourteen day's' imprisonment; the warrant, to be'suspended on the payment of ss. a week off the arrears. The defendant was also ordered to keep up the weekly payments under the original order of maintenance. W; Woods was adjudged the father of an illegitimate child, and ordered to pay 7s. (id. per week towards its maintenance. The defendant was also ordered to enter into-a bond of £50 to ensure future maintenance. Judgment was given on a point raised in i the maintenance case Maginnity v. Maginnity (alleged disobedience of a maintenance order) beard on Monday last. The parties had been divorced, and the decree had since been made absolute. There was an order in existence at the time of the divorce, and arrears had since mounted up. Mr. H. F. O'Leary, who appeared for Mie defendant, contended that the order ceased to exist when the divorce- was granted. The Magistrate agreed to cancel the order, and remit the .arrears Mr. R. Beore represented the complainant.
