'.':'. -. ..' . >.- — "•'.' ;V • ' ' A meeting of. the Lower .Hutt'Borough ':Council was held last evening, there,being present the Mayor (Mr. H. Baldwin), arid Councillors Hodgius, Meldrum, Kenipthorne, Br'assel, 'Clendori, Purdy, Ball, and Hobbs'. An opinion, on the question of the water rights of the'-Wellington : Meat Export' Company was. submitted by the solicitor to the Municipal Association (Mr.. T. F. Martin)/: to' the effect that the. council. may. .withdraw'' its permission, given in 1903, to' the' company to lay 8-inch pipes across, "and 'under, White's Line, and can give notice to that effect, after allowing a reasonable time for effecting the removal. If. the council's notice is hot given effect to, the council may ■ itself■■ remove of stop up the pipe, but as .important interests were involved/it was advised that no act amounting to' physical interference with the pipe should be performed, without first • raising the question '■ for; the determination of. the Supreme Court. Regarding'the .water, question;. "Alandl- - may do any 'act oh his own land which results in preventing the access to.neighbouring lands of water which formerly came there by mere percolation. If the underground stream flows in a defined course, the company cannot legally abstract more wafer, than is required for. purposes connected with the company's land.." —Councillor Purdy moved: "That the Wellington Meat Export Company be given one month's 'notice to remove its pipes from: White's Line, unless an'amicable arrangement bo made." ..The mover pointed l out that about £350 worth of; water per week was being removed from the borough, for nest to nothing, reckoning the price at Is. _ per 1000 gallons; After some discussion the motion was. carried. Mr. A. Ferguson wrote asking whether the council intended to devote any portion of the proposed loan of £3500 to the purchase of motor buses now running in ' the borough.—Councillor ;Ball moved that a reply bo forwarded stating that the council had no intention of taking over the present service; but an amendment by Councillor'Clendon, "That in'tho' event of. the carrying of the proposed loan, the money'be expended in the best interests of the borough," was ■'■' Councillor Purdy moved, pursuant'to notice, "That the question of "lighting the borough with electricity be considered." After.flie mover had•■ ■ quoted figures from the Borough of,-Hastings, the motion was caried by 5 to 4, and a committee, consisting of- Councillors Meldmm, Parsonage,' Ball, Hobbs, arid Purdy, was set up to report on the matter. • ' ' \ PETONE AFFAIRS. r ... The Petone'Borough Council met last evening. The Mayor, (Mr- J:' W. M'Ewan) presided, and Councillors' Forsyth, List. Cox, Bro.cklebank, Anderson, Findlay,lownsend, D'oiies, and'Trueman were also present. , ' " '.' Messrs. M'Ewen, Carter and Co., Ltd.j'wrote intimating the intention of their company to commence an action against:the council for the recovery of £45 damages suffered by reason of'one of their, horses being killed in a drain along the esplanade.—Received, A letter jvas received from the Assists ant Under-Secretary of the Department of Internal Affairs,' intimating that the Minister had further considered the matter of the closing;of the Catholic Cemetery,' and was ,not prepared to advise his' Excellency the Governor to act in this,direction at the : present time — Received. ....'•• , '..'' The engineer has been instructed to. prepare plans for the erection of a municipal boatshed 1 on the foreshore.
