' - '... ■' ; ■ Further evidence was heard yesterday :in the case' in'which' Daniel, Pat-' rick Gummings was charged with tho theft of shaving material and other articles, valued hi all at ,17s. 6d., fhej property of Claude ■.Fellows': Thompson.'' The theft;was alleged to have taken place at the Hotel Cecil on the evening, of June 29. Mr.'i>. G. A'. Cooper, S.M., was on the '.Bench, and Chief Detective Brobe'rfi proseclited. . •" Cliarles Edward Aldridge, the manager, of the Hotel Cecil, described hojv he- had watched the accused on the' evening' <in question, and how, after a long pursuit through the Streets, ho had finally caught him. The accused, remarking that lie had only. come out: of gaol that morning,- said: "You've got me beat'; give me a chance and I'll tell you all." .Witness then took him'to the police station, where tho articles mentioned in tho information . were found in.his possession. '-- Further evidence having been given, accused pleaded guilty find was remanded to the Supreme Court for sentence. ' ■ : •' OTHER CASES. * . ; Mary Barclay was fined £2 for insobriety—in default seven days' imprisonment.. Uii a charge of escaping from tho Salvation Army Homo, she was sent to';gaol for a month. 'For insobriety Edward Cassidy was filled 405., and eoveral first offenders were leniently dealt with. A LOST BOAT. YACHTSMAN SUED FOR DAMAGES. A claim for ,tho,value, of.a sailing" boat, alleged to have been lost through carelessness on. the part of some yachtsmen, was the basis of a civil action' heard by Mr. W. G. Riddell,- S.M. Phillip .Barrett, seafarer, sued Bnsil L. Donne, importer, and Guy Hoggard, settler, for JW4, being the. value of a boat owned by the ■ plaintiff and alleged to have been lost through carelessness on the part of the defendants. '~.; ... , The plaintiff's story was to tno effect that since January ho had made a practice of mooring his sailing boat by ropo and chain to a buoy in Balcna (Martin's) Bay, in Evans Bay. On May 10, the defendants interfered with the mooring of the boat in endeavouring ■• to get thoir yacht White Heather on to tho slip. As a result of the interference the plaintiff alleged that, tho boat was .\ost, and this was lOccasioned by an alleged wrongful aot by defendants. The boat was a new one and with its fittings was valuod at £24. For the defence it was admitted that the boat had been Interfered 1 with and that the defendants wero justified in doing so. The yacht White Hqathcr.'had been towod to Martin's Bay in order to bt placed on the slip. As. the tide was unfavourable the defendants took their yacht out to tho buoy for the purpose of mooring it. The plaintiff's boat was also moored to the buoy and the
defendants,; in-order to avoid trouble to'either boat, .unfastened ,tho mooring lino of the plaintiff's boat, and refastened it to the. stern of the yacht. When the yacht was placed on the slip at a'later date the plaintiff's boat was securely fastened to the buoy. The plaintilf's boat was amateur built and was not, in the opinion of the defendants, worth £24. , ..,■■■. ' . A PLUMBER'S CLAIM. D.' M'Kenzie, r salesman, disputed a claim made by C W. Martin, plumber, for; 10s., being balance of money alleged to be due for -work done and goods supplied by the plaintiff to , the defendant, 'file defendant in evidence said that the amount had been over-, charged. After hearing the evidence the (Mr. D. G. A. Cooper, S.M.), .gave judgment for.the .plaintiff (Martin) for tlio , amount claimed, with Court costs Bs. Mr. R. M.
