DIVORCE CASES

In a wife's petition for divorce on the technical ground of desertion, Agnes Elizabeth King was petitioner, and Georgo Alfred King, of Dunedin. respondent. Pis Honour tho Chief Justice (Sir Robert, Stout) was on the bench. Mr. Sim appeared for petitioner, and respondent appeared in person. Tho petitioner gave evidenco to the. effect that, during tho past livo years, she had received no- maintenance from her husband. Tho respondent admitted this to bo correct. His Honour said that under the Act of 1913, failure to pay maintenance was equivalent to desertion, and the petitioner was entitled to a decree. There was no ehargo against, respondent of any misconduct other than what the law called desertion. Ho would make an order lor a 'decreo nisi, to bo jnado absolute after threo months. An orde.r to onablo tho respondent to seo tho ono child of the marriage at monthly intervals was added. George Stewart M'Gregor petitioned' for divorco'from Martha M'Grerror, on the ground of misconduct. Thomas Asher was named as co-respondent. Mr. 11. F. Ayson appeared for petitioner, and Mr. P. J. O'Regan for respondent. Tho co-respondent was not represented by counsel. Evidence was giv2ii by petitioner and also by James' Baddcn, hotel porter. A decree nisi was granted, to he made absolute after threo months, with costs £2o against co-respondent.
