The- plaintiff asked tho Court to rescind tho agreement to- purchase, and order tho return of two deposits— £107 and £1000—together wifh the Bum of £150. In the alternative, if the plaintiff could not ha\c rescission of the agreement, he prajed that he be granted the sum of £1500 damages. Tho defence, filed domed misrepresentation,' and stated that nil stocks of tjio defendant firm and its hooks were handed to iho plaintiff for his inspection, and tic Fiad declared himself satisfied before, entering into the agreement. Tho hearing of evidence occupied tho day, and tho ease nas not concluded \UieiT tho Court rose.
SUMMONS RE LIBEL SUIT. His Honour Mr. Justice Hosking delivered judgment on tim summons by plaintiff in the "New Zealand Times Companj, Ltd.—Wellington Publisfting Company, Ltd., libel action, in which summons further particulars_ of the statement of defence weie desired. His Honour's decision was in tho direction of ordering the defendant to supply further particulars.
