. DECISION ON THE APPEAL.' (Bx Teleeraph—Proos Araoolatlon.)' Christchurch, February 17. In. the appeal of. E. Amyes, owner of Oxcnhopo, against tho decision of ,the Dunedin District Committee endorsing a decision of the Dunodin Jockey Club disqualifying Aymes, M'Auley (trainer), and -J. T. Humphries (jockey), 'ami Oxenhopc for two years , for an obvious pull, tho judges decided that the decision of -the Dunedin Jockey Club on aii obvious pull was not open to review' by them, but they have no. reason to question the justice of that decision. They consider that tho question of complicity of an owner or trainer in such an act is one of infprencc from the attendant circumstances and tho pvidenco procurable, and, -therefore, they have power to entertain an appeal by an owner or trainor. In this case the judges dismiss the appeal on the '. following grounds:—'The appellant be.foro the District Committee wilfully made a false statement that ho had supported the horse for £22 on tho totahsator, '.whereas that money was not invested .for himself. The appellant has refused 'to supply information required from • him by'.the judges, and failed to perform,acts ordered by the Judges under Part-XXXIII; Rule 1, of'the Rules of Racing. Under the circumstances the judges, cannot exonerate tho appellant from complicity in the pulling of Oxenhope, and, therefore, they confirm tho sentence imposed by the stewards of tho Dunedin Jockey Club. In view of tho decision appealed agains'6 being basod on the fact of an obvious pull, and not on tho evidence of appellant's complicity, the judges arc of opinion that the case was a proper one to be referred to them. They therefore order the appellant's deposit to bo refunded. Sir Georco Clifford and Messrs. 'Huc;o Fricdlandcr and B. L. Lane were the judges.. . :
