RIVAL WITNESSES IN COURT, ' ■ An unusual application was mad© in • : ■. tho Court : yesterday. by Chief Detective Broberg. It concerned a disagreement botweeu two of the police . witnesses in the informations Police v. Henry Martindalo, in which defendant Martmdale was charged with having published betting cards on behalf of ■■' Scott and Martindale. The cases were .adjourned until to-day. i Mr. Broberg said that one of the witnesses, Porter by name, had obtained ''.possession-of'some notes relating to tho case from another witness, and had ■ kept thorn.- Ho asked the Magistrate ■'■;: to order that, the note's be returned ■V at once, otherwise tho witness might ■■■V.' destroy them beforo the case came on '■• for;shearing. ; ' . ..'■... The witness Porter was then called up from tho body of tho court, and, as; he carao forward'ho was observed to take from his waistcoat pocket a folded scrap of paper. He did not part with'it; however. Presently tho Magistrate (Mr.-E. W. Burton) 'inquired who : the other witnoss was, and Porter replied, "My wife, sir." Mr. M. Myers (counsel for the defendant in the action): Apparently.it is . ..'■ a> matter between husband and wife, lour Worship. ■. ', ■■•■;:'. Mr. Broberg said that the wife was a voluntary witness, but he had reason to'beliove that the husband was a hos- :..; tilo witness. There was a.chanco that Porter' would destroy tho notes, and : then the damage would be done. I ' . Tho. Magistrato said that ho did not ■ ':•'■ seO that he' had any power to direct Porter to return the notes, ' but he warned i Porter that he would be re- ■ quired.to .produce, them at the hearing of the caso on the'following-day. .
