They considered that tho question of complicity of t'ho owner or trainer in such. an. act was one of inference from the attendant circumstances and tlio evidence being procurable- they tfhe-refor© had power to entertain an appeal by tho owner or trainer. In this case they aro not satisfied there Tine evidence of complicity of M'Aulay and uplicld his appeal. The judges (Sir Georgo Clifford, Messrs, Hngo Priedlander, aμcl B.
