Meyer, o! 31arton, for A! 790 on a promissory note, by Meyer for a carrying business, l'laintilf's evidence was to tho effect that Jloyer purchased tho business for a man named Gibson. Plaintttt was cross-examined at considerable length in connection with letters supposed to havo boon'written by Gibson, pving Meyer instructions to buy piece. Hand-writing and illiterate SR n il'i i 2 were sworn to l\v expertnkses as being identical. After a strong summing up His Honoctr put tho following issues to the jury i-DK the plaintiff write and send Giteon s letters to tho defendant? Did defendant act in dealing with the plaintiff on tho assumption that these letters two Eonuine. and was he misled by tlioso letters? The jury after an honr and a half returned replies of • lea to both issues. Judgment was, therefore, ■riven for defendant. His Honour in stnictcd the Registrar to not the aocttments into tho hands of tho Crown I solicitor in oruer to sco wiiethor there we proimds for a prosecution against Nieholls for perjury, if not for forgery and attempting to obtain money by false prrtonws.
