A BANKRUPT SOLICITOR.

IMPORTANT COURT CASE. (By Telegraph.—Prasa Assoc,ii,t!oa.) Christcliur-cir, December 1. An important action was commenced at tho Supremo Court to-day, before Mr. Justice Denniston, arising out of tho bankruptcy of Walter Shaw, solicitor, of Timaru. Tho caso was ono between tho Official Assignee in bankruptcy of property of Walter- Shaw and tho Timaru Property Company, Ltd., carrying on business as tho Land and Investment Company; John lmric, Jaiul agent; Mark Higgins, land agent; Frank Archibald Raymond, accountantj/and Samuel Trevnrza, of Mount Eden, retired, farmer.. Mr. Myers, of Wellington, with him Mr. Kinnermey nnd Mr. Weston, appeared for plaintiff; Mir. Skerrett, K.C., with him Mr. Cas&idy, appeared for all tho defendants except Trevurza; nnd Mr. Hosking, K.C., with him Mr. Aeland, for Trovtirza. The ease was one in which it was alleged that company in December last had taken over a largo amount of property from Walter Shaw, who filed in the following April. The Assignee's action :Was taken with a view to securing the property for. the creditors. Plaintiff claimed: (1) That the agreement and transfers and all related documents should be adjudged void' or bo set asido against him, moro particularly under the rules of equity and the law of bankruptcy, on 'such comktions as' tho Court should deem just. (2) That account should he taken of al! moneys received by defendants or any of them in rospeet of salesor other dispositions or rents and profits comprised ill the agreement of December 21, 1912, and that the amount found duo should be adjudged to be paid by plaintiff, less ail just allowances. (3) Alternatively, that defendants or such of tlieiu slwuld be found liable, should be adjudged to plaintiff such damages as ho might on inquiry ho shown to have sustained. (4) That account should be taken of all monevs owing br defendant, Samuel Trevurza, to Walter Shaw ftt date of bankruptcy; that the amount found duo should bo adjudged to bo a charge on lines comprised in tho agreement; that the lands should bo sold subject to all prior charges, and that Samuel Jrevuraa should be adjudged to pay wo balance, if any, to plaintiffs. Mr. Myers's address 111 opening lasted from 10.30 a.m. till 2.20 p.m. The evidence of Walter Shaw wag then taken. Witness was still under examination when tho Court adjourned for the day. .
