The civil business at tho Magistrate's Court yesterday was conducted by Mr. J. S. Evans, S.M. Edwin SnviUe, cycle dealer, Wellington,, proceeded against Rand, }l a $ or > an<l Co -> mercantile agents, Wellington, claiming the sum of £13 lps. for materials furnished in connection with a motor-cycle.' After hearing the'evidence- His Worship non-suited plaintiff, and allowed no costs. Mr. Maeholl appeared for tho plaintiff and Mr, E. C. Levvey defended. ~ Judgment for plaintiff was given in ■tho following undefended cases:—A. Mitfllic-M and G, Goodwin v- Daniel Ipm, £8 17s. 3d., costs £1 3s. fid.; W. Miles Taylor v. Ernest Miles. £2 Bs., costs 125.; g. S. Williams Co., Ltd. v. George- Jones, £5 18s. 5d., costs 8s.:" ! Fatzgibhon and Perry v. Fitzgerald Clarke, £21 lfis., costs £2 14s. • tho Bur Iniprotinjr Company v. Dr. Guy Haskins, £14 Bs. 2d.,"costs £1 10s. 6d.; -Empire. Loan Co.- v.. (3d.,: Charles W. ftiolson v. William -Henry Barnes, £12, costs. £1 10s. 6d. W, G. H. Baillifl was ordered to pay Greoh and Davis £1 Is. 3d. by December 4. Tai Haketa- was ordered to pay Sutherland and Rankin© £41 2s. '9d. Forthwith, .the warrant to be.suspended, if the-defendant pays £10 "per month. POLICE SIDE. ' CHARGES AGAINST A CLERK. The Court (Mr. W. G. Riddel] pre*' siding) opened the hearing of tho ease in Which Alfred Edward Toroliiison is cbafged with hn-viiig failed to account for £50 3s, Cd., belonging to his employers, Messrs, (kdlin and Co., Ltd., : with having -stolen the' same "amduiit," with having set fire to books and papers ■ in-Messrs. Goilih and Co.'s building, and with having stolen £6 10s. belong* jug to the Imperial Oil Co., Ltd. Some evidence was taken, and at' 5 ■o'clock .an adjournment till this- after*" noon was made. Mr. M. Myers appeared for tho prosecution, and Jilt. I*. W. Jackson represented the defendant. , ,: . The evidence given w;as to the'effect that on tho evening of November t a smell of something burning gave rise.to tbe-suspicion thai the building was on .'fire. The fire- brigade' was sent- for, and ;it was eventually discovered that some papers were burning in the strongmom. A littlo later it was decided to send certain books and papers to, an auditor, and it was discovered that Tom!'liiuion, who was aware that tlio documents were being sent away somewhere, i parcelled rip some of them and took them to his desk. Subsequently Tomlir.son admitted to tho acting-manager (Mr. D. A.' Hamilton) and' Detective ■-Andrews that he had.taken certain money for his own purposes.
