DEVON CASE TO BE RE-HEARD

—: — MINISTER'S DECISION. Tlio Minister for Marine (Hon. F. Mr B. Fisher) lias, after taking all the circumstances into consideration, granted Mr. M. Myers, counsel for Captain Caunce, of tlie wrecked steamer Dovon, leave for a re-hearing of tlio base, which will most probably bo heard before a Judge of the Supremo Court and two assessors. Tlio circumstances governing the application for a re-opening of the in-' quiry, which was held this week boforo Dr. M'Arthur, S.M., and Captains Bollons and Black, assessors, will be fresh . in the memory. One of tho assessors. Captain Black is a coastal pilot, and prior to tho Devon leaving Auckland, had offered his services as coastal pilot to Wellington at a fco of £21, which offer was''declined. On tho ground that this circumstance might have proved prejudicial to his client, Mr. Myers (who had not had- tiino to protest before the inquiry) applied for re-hearing. Tho Minister was not disposed at first 'to grant tho request, and quoted in his lotter that Captain Black was the only • mombor of the Court of Inquiry who was against the three months' suspension of Captain Caunce's certificate. Other counsels, howover, have sinco prevailed, and' tho desired re-hearing lias been granted. The inquiry will probably be held next week. Tho Minister's letter to Mr. Myers read as follows: —"Dear Sir, —I liavo most carefully considered your application for a re-hearing of the case relating to the wreck of the s.s. Dovon. In 'view of tlio fact-that Captain Cauiieo is debarred, by reason of tho consider- t able expense likely to bo entailed by an appeal to tho Supremo Coui;t, from seeking tho redress to which he considers lie is entitled, I have instructed the Secretary of the Marino Department to take the necessary steps for a re-hearing of the case.—Yours faithfully, "F.
