In tho course of his judgment, his Honour said, "I think tho Legislature, by the Act of 1911, has expressly enacted that water on rates, whicli-wore theretofore leviable on he the capital or annual value, shall thereJ, r . after not be so levied, but shall be leviij]l able on the unimproved value, The diflT ficulty is that the draughtsman, so .far its as I oan see, has unfortunately omitted on to provide the nccessarv machinery for enabling th»rilte to b« lovied inaccord- ■ ance with tho enactmont, and there is : 110 other wn.v of levying it. It is boyond .. the power of this Court to provide the ,]t' machinery. That-rests only with the ni Legislature. .'The plaintiff.is entitled to an injunction." . . •
