SUING FOR DRINKS.
OPINIONS OF A MAGISTRATE. 1 (By Toleirrajih'-HDCiial OorrosnondenU Auckland, August 21. A' judgment' debtor who nppoored in the Auckland Magistrate's Court to explain why ho could not pay a sum of J3l 125., and costs, due to a publican, told Mr. Kettle, S.M., that tho debt was for drinks supplied. "But a licensee cannot sue for drinks chalked up," said Mr. Kettle. "Tho Licensing Act prohibits it. I seo ho is suing for goods sold and delivered." "Aro you sure it wasn't, for drink, not drinks?" asked tiro solicitor for tho creditor. "No," said the debtor. "I shouted for several people in the bar. Tho licensee had a drink, and tho barman had a packet of cigarettes, and I think tho licensee's wife had a soft drink." There were about ton drinks altogether.
"If I had known of this I should never havo given- judgment," said Mr. Keltle, "and if the solicitor knew of it ho should havo disclosed it." 1
The solicitor explained that, ho knew nothing of tho circumstances under which 1 the debt was incurred, but Mr. Kettle declined to make an order. "If you owo the money," ho .said to the debtor, "von ought 'to pay, though I am not making an order against you."
