COMPENSATION COURT.

CHILDERS TERRACE PROPERTY. BOYD'S CLAIM FAILS. • His Honour (Mr. Justice Sim) delivered judgment at tho Compensation Court yesterday in an action in which John James Boyd claimed .£2OOO from tho Wellington (Jity Council as damages for alleged depreciation of liis property in Childers Terrace. The claim was made under tho Municipal Corporations Act, 1908, and the Public Works Act, 1908. The case was heard in the Supremo Court in Juno last, before his Houout Mr. Justice Sim, In delivering his decision, his Honour said that the Supreme Court having decided that the claimant was not entitled to recover compensation, the determination of the Compensation Court was that no compensation was payable. The Court had also decided that no costs bo awarded. Tho fee of each assessor was fixed at twenty guineas, and each party was to pay its own assessor. Tho assessors hail expressed tho hope, added his Honour, that the corporation would meet Mr. Boyd fairly and provide access to his houses, f as it had done for tho residents north of Mr. Boyd's property. Sir John Fimllay, with him Mr. D. M. Findlay, appeared for the claimant, and Mr. j.' O'Shea (City Solicitor) appeared for the City Corporation.
